Sheriff Chris Abril remains a free but will travel out of Polk County for his trial.
Sheriff Abril is charged with five counts of first degree statutory rape from an alleged incident that happened 20 years ago involving two underage girls.
The State requested a change in venue on Tuesday after arguing the Sheriff had contact with two potential jurors. The Prosecutor would not elaborate to the media about the Sheriff's contact.
Abril's attorney told News Channel 7 that the Sheriff did one of the potential jurors. Abril's attorney also supported a change in venue after interviewing several potential jurors.
The judge ruled against the State's motions for a mistrial and to revoke the Sheriff's bond.
