On Tuesday, Aug. 19, the N.C. Court of Appeals affirmed the decision of the Wake County Superior Court upholding the laws known as the Sullivan Acts.
The first of the Sullivan Acts was adopted in 1933. Among other things, the law prohibits the City from charging higher rates for water sold to customers in Buncombe County. Shortly before the Water Agreement was set to expire in 2005, the NC General Assembly adopted laws to expand the coverage of the Sullivan Act, and to restrict how the City could spend water revenues.
The City’s lawsuit claimed that the Sullivan Acts were unconstitutional.
The City’s attorneys are reviewing the decision.
