The man accused of kidnapping a North Carolina family waived his detention hearing and preliminary examination in federal court Monday morning. Investigators said Jerry Case kidnapped a man, his daughter, and her two children in Gaston County, NC on July 18, 2009.
The victims were able to escape when Case stopped at a gas station in Cherokee County, SC. Deputies shot Case after they say he fired first. Cases's sister has said her brother acted out because he thought he was going to prison for drunk driving and wanted to say good-bye to them.

At Monday's hearing, Judge David Cayer continued Case's detention hearing and preliminary examination until the grand jury meets again in August.

Case was sentenced to death row in 1986 in the killing of a Tennessee taxi driver. He got a life sentence on a retrial and was
released on parole in 2007.

Case has been arrested four times since his release.
