United States Attorney George E.B. Holding announced that on February 25, 2009, a Federal Grand Jury returned a single count indictment charging 20 year-old Kody Ray Brittingham, of Camp Lejeune, North Carolina, with threatening the President-Elect of the United States, in violation of Title 18, United States Code, Section 871, which has a maximum penalty of 5 years imprisonment followed by up to three years of supervised release and a fine of up to $250,000.
The Indictment charges that in November, 2008, Brittingham threatened the life of then-President-Elect Barrack Obama. He stated, among other things, that he intended to shoot the President-Elect.
Mr. Holding stated: “We take all threats against the President and other high officials of the United States very seriously. The threat itself represents a disruption of the United States Government, even if no actual attempt is made to carry out the threat.”
An indictment contains allegations that a defendant has committed a crime. Every defendant is presumed innocent until and unless proven guilty in court.
