Courtroom Updates: Trial Of Man Accused Of Killing Pregnant Girlfriend

Updated 2:56pmPublic defender John Mauldin is right now calling for a mistrial saying the police officer gave hearsay testimony about what Elizabeth Burdine told him on scene that her son was chasing and shooting at them.

Motion denied.

Greenville Police Officer Tim Conway just testified to the statement he took from Elizabeth Burdine the night of the crash. Conway says she seemed alert and fine to talk.

Eileen Elizabeth Smith just testified.

She was also a witness to the crash.

She says both cars flew by her and she felt like Potlow's car was agitating the other causing it to crash. She saw the car lose control at least twice before crashing.

During Donna Goodwin's testimony, she told the court she can only remember a snippet of the night.

She had a serious injury in the crash and was in a coma for five days.

Goodwin did say she wanted to get out of the car when a victim, Vanessa Vance, got in saying Potlow had a gun, but Burdine told her to stay in the car because he would kill her.

Right now lawyers are arguing about a statement Elizabeth Burdine -- Potlow's mother and the driver of the car -- gave in the hospital that she says she does not remember giving.

Judge Miller has agreed to let Burdine come back in and clear up the inconsistencies in what she us saying.

The jury is coming in now and Donna Goodwin is taking the stand. She was a passenger in the car who survived the crash.

Jurors will hear from witnesses and a medical examiner today in the trial of a man accused of killing two women and an unborn baby.

Yesterday, the suspect's mother took the stand saying 911 operators did not answer her call for help.

Prosecutors say elder Dennis Potlow had been fighting with his pregnant girlfriend in April 2007 when she jumped in a car with his mother.

They say Potlow chased after them in another car and rammed it until they crashed in Greenville county.

Elizabeth Burdine is Potlow's mother. She continued to tell the jury that she never saw her son with a gun but others in her car did.

Investigators estimated her car was going 75 mph when it crashed.
