Appeals Court Won't Drop Lawsuit Against Clemson

A federal appeals court has again refused to dismiss a lawsuit against Clemson University and its trustees.

CLEMSON, S.C. (AP) - A federal appeals court has again refused to dismiss a lawsuit against Clemson University and its trustees.

The Anderson Independent-Mail reported Wednesday that the U.S. 4th Circuit Court of Appeals rejected the school's request to reconsider an order refusing to dismiss the lawsuit.

An appeals court judge last month dismissed Clemson's claim that it could not be sued because it is an arm of the state.

Former Clemson board executive secretary Eugene Troutman sued the school last year after he was fired. Troutman said he was fired because he said the university's tuition and fee increases were unnecessary. He said the board used tuition to help build an $80 million, unrestricted fund. He also questioned raises given to school administrators.

School officials have denied any wrongdoing.
