SAVANNAH, Ga. (AP) - A 53-year-old Georgia man jailed on charges he tried to stalk Miley Cyrus is scheduled to return to court two days after a grand jury refused to indict him.
Mark McLeod was scheduled to appear Friday morning before a State Court judge in Savannah, where he's been jailed since August.
Police say McLeod twice came to nearby Tybee Island looking for 16-year-old Cyrus and resisted officers who tried to remove him from the set where the "Hannah Montana" star was filming a movie on the Georgia coast.
A grand jury on Wednesday decided prosecutors lacked sufficient evidence to make a felony case against McLeod. He still faces misdemeanor charges of attempted stalking and disorderly conduct.
McLeod's attorney, James Byrne, says he never posed a threat to Cyrus.
